Any Item you purchase from MPB US (including through Trade-in) is covered by a six-month limited warranty (the “Warranty”), unless otherwise stated. Items sold for spares/repairs in a stated faulty condition are excluded from our Limited Warranty. This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
This Limited Warranty extends to Items purchased directly from MPB US. Items sold on the Platform for spares/repairs in a stated faulty condition are excluded from our Limited Warranty. This Warranty does not cover your Item if you use it in a manner incompatible with its intended use.
This Limited Warranty extends to the purchaser of an Item from MPB US. All MPB US warranties, including any implied warranties, are valid only for the period of time the Item is owned by such purchaser. The “purchaser,” for the purposes of this Limited Warranty, is the first purchaser of the Item from MPB US. Please retain a copy of your receipt as proof of purchase. This Limited Warranty is not transferable.
MPB US warrants the Item in the packaging sold to you against the defects in material and workmanship set forth below (“Defects”) for six months from the time the Item is initially purchased by you, solely when the Item is used normally for its intended purposes. If you obtain a replacement Item through this Limited Warranty, the Limited Warranty for such replacement Item will only last for the remaining duration of the six month period that began with the original purchase.
This Limited Warranty extends to Items purchased through the MPB US website (the “Warranted Products”). This Limited Warranty does not extend to any product that is not obtained through the MPB US platform (including, without limitation, any non-MPB US product that is attached to or used in connection with the Warranted Product).
In the event of a Defect, MPB US’ sole and exclusive liability and your sole remedy under this Limited Warranty will be, at MPB US’ option, to provide a repaired or replacement Item, subject to your fulfillment of “Your Responsibilities” below.
This Limited Warranty does not cover:
Any consumables (such as batteries)
Regular wear and tear resulting from normal usage of the Item
Damage or faults caused by shock, impact, fall, sand, dust, dirt, damp or corrosion, leaky batteries, an act of war or terrorism, fire, theft, attempted theft, accidental or malicious damage, vandalism, corrosion, water contamination or ingress, frost, flooding or other adverse weather conditions, repair and/or cleaning by unauthorized personnel
Faults that have occurred because you have not used, stored or handled the Item(s) properly or have not followed our written instructions for the Item(s), or the instructions of the manufacturer, or damage or defect due to willful neglect or negligence by anyone other than us.
Faults relating to image sharpness of a lens that is clearly open to human judgement, or where the parts are no longer produced, such that the Item(s) cannot be repaired or where the loss of quality, degradation of performance or actual damage that results from the use of spare parts or other replaceable items (such as consumables) that are neither made nor recommended by the manufacturer and well as faults due to the connection of other fittings or accessories to the Item(s) which MPB US has not approved.
Without limiting the foregoing, the following exclusions apply to this Limited Warranty with respect to drones.
a. This Limited Warranty is void if the drone has been crashed in ATTI mode.
b. This Limited Warranty does not cover (a) damage caused by crashes or fire caused by non-manufacturing factors, including but not limited to, pilot error (b) damage caused by unauthorized modification, disassembly, or shell opening not in accordance with official instructions or manuals, (c) damage caused by improper installation, incorrect use, or operation not in accordance with official instructions or manuals, or (e) damage caused by repairs, modifications, or other work performed by a non-authorized service provider.
In the event of a Defect and in order to get the benefit of this Limited Warranty, you must return your Item to MPB US and provide MPB US with proof of the original date of purchase. In order to return your Item, you must email MPB US at [email protected] or call +1 332 286 4119 to obtain a Return Authorization Number. If you are not able to speak to a representative over the phone, you must email us at [email protected] within this warranty period. Should shipping costs be required to return your Item and only if you are located within the United States, MPB US will cover these costs by providing a shipping label for a courier service chosen by MPB US. You would be responsible for any packaging costs when returning the Item under warranty. Shipping costs for warranty claims will not be covered by MPB US if you are located outside of the United States. Evidence of a Defect and any claims must be sent to the address set forth at the end of this Limited Warranty.
MPB US will repair your Item or replace Item with a like-for-like model in like-for-like condition (as applicable) and ship your Item back to you. MPB US will be responsible for the shipment back to you of any repaired Items, as long as you are located within the United States. To the extent permitted by applicable law, the foregoing shall be your exclusive remedy and MPB US’s sole liability for a claim related to a Warranted Product under this Limited Warranty.
TO THE EXTENT PERMISSIBLE BY APPLICABLE LAW, ITEMS ARE PROVIDED “AS IS” AND THIS WARRANTY AND ANY IMPLIED WARRANTIES ARE YOUR EXCLUSIVE WARRANTIES WITH RESPECT TO THE WARRANTED PRODUCTS AND REPLACE ALL OTHER WARRANTIES OR CONDITIONS, EXPRESS OR IMPLIED. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW AND EXCEPT AS SET FORTH IN THIS LIMITED WARRANTY, IN NO EVENT WILL MPB US OR ITS SUPPLIERS BE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO THE ITEM OR ITS USE BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. THIS LIMITATION WILL APPLY EVEN IF MPB US HAS BEEN ADVISED OF SUCH DAMAGES AND NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. MPB US’ TOTAL LIABILITY WILL NOT EXCEED THE PURCHASE PRICE PAID FOR THE ITEM GIVING RISE TO SUCH LIABILITY.
SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
This Limited Warranty will be governed by the laws of the State of New York, without regarding to conflicts of law principles that would require the application of another jurisdiction’s laws.
